COURTSEE TERMS & CONDITIONS OF USE

These Terms and Conditions (“Terms”) govern your use of the services (“Services”) provided by CourtSee (the “Company”, “we”, “us”, or “our”) through our website, applications, and on-court technology (collectively, the “Platform”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
1. INTRODUCTION
CourtSee is a technology platform that enhances the experience of players in racket and court sports by enabling automated match recording, streaming, and analysis.
The Services include:
- Smart cameras installed on sports courts
- QR code or app-based activation of recordings
- Web and mobile platforms for viewing and analysis
- Cloud-based storage of match recordings
CourtSee supports multiple sports, including padel, tennis, pickleball, and other court-based activities.
2. ACCEPTING THE TERMS OF USE
By using the CourtSee, registering as a user in our Website, recording or live streaming matches, purchasing premium services, payment for membership accounts , or any other information or tools provided as part of the Services, you are accepting the Terms and Conditions as well as the Privacy Policy of CourtSee. By accessing and using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions and the Privacy Policy. If you do not accept these Terms and/or the Privacy Policy, you are not authorized to use the Services, and you must cease using the Services and cancel your subscription in accordance with our Cancellation Policy as described below. We may amend these Terms or Privacy Policy at any time by posting a revised version on our website. The revised version will be effective at the time we post it. By continuing to access and use the Services after the Terms or the Privacy Policy have been modified, you will be considered as having expressly accepted to all amendments to the Terms and Privacy Policy.
3. ELIGIBILITY
The Services are intended for Users, who are thirteen (13) years of age or older. CourtSee may provide Services to Users, who identify themselves as under the age of 18, only where we receive verifiable parental consent. Any User under the age of 18 must review the Terms with his/her parent(s) or legal guardian(s) to ensure that both the User and the parent(s) or legal guardian(s) understand and accept both the Terms and Privacy Policy. A parent or legal guardian who accepts the Terms on behalf of a child agrees to assume full responsibility for the child's use of the Services, including any financial charges and legal liabilities that the child may incur.
4. USER CONTENT
Users may utilize their personal Content solely for non-commercial purposes. Users are responsible for all activities conducted through their CourtSee accounts and must keep their login credentials secure to prevent unauthorized access. CourtSee disclaims responsibility for any loss of Content due to unauthorized use or account storage limitations, which may lead to deletion of excess Content. CourtSee does not pre-screen User Content and assumes no liability for any User activities or Content shared. CourtSee retains the right to edit, remove, or decline to post any User Content at its discretion.
5. USER CONSENT
By scanning the QR Code at the court entrance to connect the camera and begin streaming, the user consents to the recording of the match involving all four players. This action also grants CourtSee the right to use the recorded video and audio content for promotional purposes on social media, websites, press, and other platforms associated with CourtSee.
6. CLUB CONSENT
According to the contract between the Club and CourtSee, each club is responsible for informing its players and members, ensuring their consent for being recorded and streamed live online. The club may initiate recordings using its own account and must obtain explicit consent from participant players, bearing responsibility for processing the images and audio from the match.
7. USER INTERACTION AND STREAMING SERVICES
No participant or player may initiate a live broadcast of match cameras for matches in which they are not participating. Violation of this rule grants CourtSee the right to pursue legal action and to delete the offending user account. Users are solely responsible for their interactions with others, whether online or in person, and must not misuse CourtSee’s Services for harassment, privacy violations, or unlawful activities. Users should exercise caution and conduct due diligence before meeting others. Furthermore, CourtSee agrees to assist by providing any required evidence to the relevant authorities in relation to legal actions arising from violations of this clause.
8. DATA TO BE PROCESSED
Data Collection and Storage
The data collected through registration and contact forms will be stored on servers managed by Cloudflare and AWS. In accordance with its Privacy Policy, Cloudflare and AWS affirm their compliance with applicable local data protection and privacy laws.
Consent of Minors
Minors under the age of 18 cannot legally provide consent for the collection of their personal data by an online business. Such consent must be provided by their legal representatives (i.e., parents or guardians), except in cases where the minor has reached the age of 18, at which point their consent is considered legally valid. The legal guardians bear full responsibility for any actions taken by the minor in relation to the provision of consent.
9. EMAIL AND NOTIFICATIONS COMMUNICATIONS
By accepting these Terms and Conditions, the user consents to receive marketing materials from CourtSee via email from the email address 📧support@courtsee.com and/or notifications center in the CourtSee Platform. This includes relevant information, updates, newsletters, promotions, discounts, and special event invitations. Users may withdraw their consent and opt-out of receiving such communications at any time by notifying CourtSee.
10. SERVICE PLANS & PAYMENT
The Free Plan allows users to register and watch streaming matches and videos at no cost but with limited functionalities. To access premium features, users must purchase the Premium Plan. CourtSee offers free and premium services accessible through a subscription cost (“Membership”), which can be monthly or yearly and is subject to the fees listed on the Website. Membership will continue until terminated by the user, with all fees paid in advance.
Payments must be made via a valid credit card or other accepted payment methods determined by CourtSee. We may engage subcontractors or affiliates to collect payments on its behalf, which will be processed through a third party. By subscribing, you authorize CourtSee to charge your credit card or payment method on a regular basis as per the applicable fees, starting from the beginning of your Subscription until account termination.
If automatic payment cannot be processed, CourtSee will notify you via email, and your Subscription will be suspended until payment is received. All fees paid are non-refundable. CourtSee reserves the right to change payment methods and fee schedules at its discretion, providing prior notice to users via email and on the website
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, CourtSee and its affiliates, officers, and agents (collectively, “Released Parties”) are not liable for any direct, incidental, indirect, or consequential damages, including lost profits or data, arising from the use or inability to use the Services, even if advised of potential damages. If CourtSee is liable for any damages, its liability is limited to the total subscription fees paid by the User. By using the Services, you waive any claims against the Released Parties related to your use of the Services.
12. ACCESS TO USER REVIEWS
Users can submit reviews of the website’s activities and services using a designated form. By accepting the Privacy Policy, users consent to share their data and images to CourtSee and other users of the platform, which will include their name and profile photo. If users do not wish to share their experience or personal content, they should refrain from using this service.
13. PRIVACY POLICY
CourtSee’s Privacy Policy is by reference an integral part of these Terms.
14. INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights associated with CourtSee’s Services, Website, and mobile app are the exclusive property of CourtSee or its licensors, protected under copyright, trademark, and patent laws. This includes all related logos, designs, and software. The use of CourtSee’s QR Code system and other Services is restricted to personal, non-exclusive, non-transferable, and non-commercial use. Users may not reverse engineer, redistribute, or modify any intellectual property without permission. By scanning the QR code, the user explicitly consents to the diffusion of their image on the CourtSee platform.
15. TERMINATION
You may terminate your CourtSee account at any time through the Website’s profile settings. CourtSee will notify users via email once an account is suspended. Users are responsible for termination, and CourtSee is not liable for any charges incurred due to improper termination. Upon cancellation, no content will be saved, and all accumulated content will be deleted.
16. GENERAL
The use of the Services does not create any joint venture or agency relationship between you and CourtSee. These Terms are governed by Indonesian law. If any part of these Terms is deemed invalid, the remaining provisions remain effective. CourtSee's failure to enforce any provision does not constitute a waiver of that provision. These Terms represent the entire agreement between you and CourtSee and may be assigned by CourtSee to any party without notice.
